By accessing the Site or using CCS Services, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Site or Services.
2. Services
CCS provides marketing-automation, funnel-development, and related consulting services utilizing third-party platforms including Go High Level, Google Workspace, Canva, Zapier, and Stripe. Scope and deliverables are defined in written proposals or service agreements.
3. Client Responsibilities
Clients must:
Provide accurate information and timely access to required accounts or data.
Comply with applicable marketing, privacy, and communications laws (including CAN-SPAM, TCPA, and GDPR where relevant).
Obtain consent from their own contacts or customers before importing or messaging them through CCS-built systems.
4. Payment and Fees
Unless otherwise agreed, invoices are due upon receipt. Late payments may incur a 2% monthly finance charge. All fees are non-refundable once Services commence.
5. Intellectual Property
All original code, copy, graphics, and automation architecture produced by CCS remain CCS property until full payment is received, after which ownership transfers as specified in the service agreement. CCS retains the right to display non-confidential work in its portfolio.
6. Third-Party Platforms
Use of integrated tools (GHL, Stripe, etc.) is governed by their own terms. CCS is not responsible for outages or limitations of third-party platforms.
7. Confidentiality
Each party agrees to maintain the confidentiality of non-public business or technical information obtained through the engagement.
8. Disclaimer of Warranties
The Site and Services are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, CCS shall not be liable for indirect, incidental, or consequential damages. CCS’s total cumulative liability shall not exceed the amount paid by the client for the Services giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless CCS, its officers, and contractors from any claims arising out of your use of the Site or Services or your violation of these Terms.
11. Termination
CCS may suspend or terminate Services for non-payment or breach of these Terms. Obligations relating to confidentiality, payment, and limitations of liability shall survive termination.
12. Governing Law
These Terms are governed by and construed under the laws of the State of Maryland, USA, without regard to conflict-of-law principles.
13. Dispute Resolution
Any dispute shall first be attempted to be resolved through good-faith negotiation; failing that, the parties agree to binding arbitration in Queen Anne's County Maryland.
14. Changes to Terms
CCS may modify these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
